Stoel Rives has issued a new client alert detailing provisions added to the draft emergency regulations issued by the Division of Oil, Gas, & Geothermal Resources (“DOGGR”) on December 11, 2013 (for more information on the draft emergency regulations see the December 12, 2013 and December 23, 2013 posts).

Those regulations – and the new provisions – were final beginning January 1, 2014 and will impact operators through the end of the year until DOGGR finalizes and implements its permanent regulations, due January 1, 2015. Added provisions include:

  • Clarifications on the process for seeking trade protection while also submitting an Interim Well Stimulation Treatment Notice (“Interim Notice”);
  • Definition of “protected water” and information on aquifers that may be exempt from protected status;
  • New requirements should operators seek to achieve a determination of completeness for the Interim Notice without attaching a groundwater monitoring plan
